The book

To locate the problems between Law and Truth and to emphasize its current importance and, more overly, to advance into new research lines, the present editorial project is organized by the following sections:

a) The history of Legal Truth that may enlighten both the transformation of the notion of Truth and the role of Truth in the Law within the context of the evolution of the latter;

b) An iconographic analysis of the ideas of Justice and Truth that could make envisage the complex network of relationships between Law and Truht from a different point of view.

c) The specific problems that arise from the perspective of the Legal Theory: the relations between truth and the idea of a legal system, legal knowledge (both from the jurisprudence and the philosophy), or the judicial process (the quaestio facti and quaestio juris), and thus problems that arise from the theoretical and practical reasoning, etc.

d) The issues that arise from the standpoint of different disciplines not strictly legal or usually associated with the Legal Truth, such as the philosophy in general, epistemology, sociology, or political and moral philosophy.

The book will be composed by the works of 36 collaborators, specialists qualified in their respective specialty field (whose names, university affiliations and themes that they will address, may be seen in the list attached to this Website in the "Collaborators" section), from European and American countries, belonging to the Romano-Germanic legal traditions and the Common Law, and to both analytic and continental philosophy currents, namely: Belgium, Spain, Italy, France, UK, USA, Argentina and Mexico. The contributions will be distributed into three volumes, according to the following thematic order:

Volume I is for i) general introduction of the editors and ii) papers on the history of Legal Truth and Legal Iconography;

Volume II will contain: i) the works on Legal Theory, and ii) the introductions to the sections and sub-sections in which the editors will organize such works;

Volume III, will be composed of i) some very specific works on Legal Theory, ii) other papers written from different perspectives: sociology of law, political philosophy and moral philosophy, philosophy or epistemology, ii) the introductions to the sections and sub-sections of the editors; iii) the bibliography, indexes, news about the authors, etc.

The papers are original contributions written specially for the present collective book. In addition, four works will be included that are already published elsewhere:

3. Patterson, Dennis, "Truth and Law: replies to Critics", Secc. IX Brian Leiter: Quine, TRUTH, AND NORMATIVITY (this article is independent of the original work that will also feature Professor Patterson).

4. Schapiro, Barbara, "Fact and the Proof of Fact in Anglo American Law (c 1500-1850)"

The papers not written in Spanish will be translated into this language in its final version, after the modifications that might take place as consequence of the discussions at the colloquium, (see the "Colloquium" section on this web page)

The publisher house that will publish the work in Spanish is Marcial Pons, Philosophy and Law Collection.

Calendar

The papers should be available in its preliminary version six months prior to the Colloquium so that they can be well read in advance with a view to their discussion, and preparation of the final version of the contributions.
